GEWINNSPIEL
Der Veranstalter dieses Gewinnspiels ist die AMAG Import AG, Alte Steinhauserstrasse 12, 6330 Cham (ZG), Schweiz (nachfolgend „AMAG“ genannt). Die Durchführung des Gewinnspiels erfolgt auf Basis der nachstehenden Teilnahmebedingungen, die mit der Teilnahme akzeptiert werden. Für die Organisation, Abwicklung sowie Preisbereitstellung bzw. Gewinnausschüttung ist AMAG zuständig und verantwortlich.
1.1 Dieses Gewinnspiel steht in keiner Verbindung zu Facebook, Instagram oder Twitter und wird in keiner Weise von diesen gesponsert, unterstützt oder organisiert. Sämtliche Fragen, Kommentare oder Beschwerden zum Gewinnspiel sind ausschliesslich an AMAG und nicht an Facebook, Instagram oder Twitter zu richten. Mit der Teilnahme an diesem Gewinnspiel stimmt der Teilnehmer zu, Facebook, Instagram oder Twitter von jeglichen Ansprüchen Dritter im Zusammenhang mit diesem Gewinnspiel freizustellen.
1.2 Teilnahmeberechtigt sind natürliche Personen ab 16 Jahren mit Wohnsitz in der Schweiz und in Liechtenstein. Personen unter 16 Jahren, Mitarbeiter/-innen einschliesslich deren Angehörige der AMAG sowie der mit der AMAG verbundenen Gesellschaften und andere an der Konzeption und Umsetzung dieses Gewinnspiels beteiligte Personen sind von der Teilnahme ausgeschlossen.
1.3 Mehrfachteilnahmen an diesem Gewinnspiel sind ausgeschlossen.
1.4 Preise können nicht übertragen, abgetreten oder umgetauscht werden. Eine Barauszahlung ist nicht möglich. Die Teilnahme am Gewinnspiel verpflichtet nicht zum Kauf.
1.5 AMAG hat das jederzeitige Recht, ohne Mitteilung und Begründung Teilnehmer vom Gewinnspiel auszuschliessen, die den Teilnahmevorgang oder das Gewinnspiel manipulieren bzw. dies versuchen und/oder die gegen die Spielregeln verstossen. Dies gilt ebenso hinsichtlich Teilnehmern, die falsche Angaben zu ihrer Person machen.
1.6 AMAG ist berechtigt, das Gewinnspiel zu jedem Zeitpunkt ohne Vorankündigung, Mitteilung oder Begründung unter Berücksichtigung der Interessen der Teilnehmer zu unterbrechen oder zu beenden, wenn der Verdacht auf Spielmanipulation besteht sowie wenn technische Gründe oder rechtliche Gründe eine ordnungsgemässe Durchführung oder Fortsetzung nicht gewährleisten lassen.
1.7 AMAG behält sich das Recht vor, rechtliche Schritte gegen jeden einzuleiten, der dieses Gewinnspiel manipuliert hat oder versucht hat, dies zu tun.
1.8 Am Gewinnspiel kann bis zum 15.10.2023 teilgenommen werden. Die Verlosung bzw. Gewinnermittlung erfolgt am 17.10.2023. Verspätete Einreichungen werden in keinem Fall berücksichtigt.
1.9 Folgende Gewinne sind ausgelobt:
Platz 1: 1x Logitec Rennlenkrad im Wert von CHF 400
Platz 2: 1x Headset im Wert von CHF 170
Platz 3: 1x Digitec Gutschein im Wert von CHF 50
1.10 Der Gewinner für den Gewinn gemäss 1.9. wird nach dem Zufallsprinzip unter Zeugen ermittelt.
Der Gewinner:in wird umgehend nach Abschluss des Gewinnspiels von AMAG benachrichtigt. Meldet sich der Gewinner:in nicht innerhalb von sieben (7) Tagen nach der Benachrichtigung, verfällt der Gewinn und es wird ein neuer Gewinner:in ermittelt.
1.11 Jegliche Schadenersatzverpflichtung der AMAG und ihrer Organe, Angestellten und Erfüllungsgehilfen aus oder im Zusammenhang mit dem Gewinnspiel, gleich aus welchem Rechtsgrund, ist, soweit gesetzlich zulässig, auf Fälle von Vorsatz oder grober Fahrlässigkeit beschränkt. Sämtliche mit dem Gewinn einhergehenden Betriebs-, Neben- und Folgekosten trägt der Gewinner.
1.12 Der Teilnehmer ist einverstanden, dass seine Daten von der AMAG gespeichert und im Rahmen der Gewinnabwicklung an Partnerunternehmen weitergegeben werden. Ferner ist der Teilnehmer einverstanden, dass die von ihm an die AMAG übermittelten Bilder und Videos im Rahmen dieses Gewinnspiels von der AMAG genutzt und veröffentlicht werden.
1.13 Der Rechtsweg ist ausgeschlossen. Über das Gewinnspiel wird keine Korrespondenz geführt.
1.14 Das Gewinnspiel untersteht schweizerischem Recht.
1.15 Diese Teilnahmebedingungen können von AMAG jederzeit abgeändert werden. Sollten einzelne Regelungen innerhalb dieser Teilnahmebedingungen unwirksam sein oder werden, so bleibt die Wirksamkeit der übrigen Regelungen davon unberührt.
Raffle
The organiser of this competition is AMAG Import AG, Alte Steinhauserstrasse 12, 6330 Cham (ZG), Switzerland (hereinafter referred to as "AMAG"). The competition is carried out on the basis of the following conditions of participation, which are accepted by participating. AMAG is responsible for the organisation, processing, provision of prizes and distribution of prizes.
1.1 This competition is not connected to Facebook, Instagram or Twitter and is in no way sponsored, supported or organised by them. Any questions, comments or complaints regarding the competition should be directed exclusively to AMAG and not to Facebook, Instagram or Twitter. By entering this competition, the entrant agrees to indemnify Facebook, Instagram or Twitter against any third party claims in connection with this competition.
1.2 The competition is open to natural persons aged 16 and over who are resident in Switzerland and Liechtenstein. Persons under the age of 16, employees and their relatives of AMAG and its affiliated companies and other persons involved in the conception and implementation of this competition are excluded from participation.
1.3 Multiple entries in this competition are excluded.
1.4 Prizes cannot be transferred, assigned or exchanged. Cash payment is not possible. Participation in the competition does not imply any obligation to purchase.
1.5 AMAG has the right at any time to exclude from the competition, without notification and without giving reasons, participants who manipulate or attempt to manipulate the participation process or the competition and/or who violate the rules of the game. This also applies to participants who provide false information about themselves.
1.6 AMAG is entitled to interrupt or terminate the competition at any time without prior notice, notification or justification, taking into account the interests of the participants, if there is a suspicion of manipulation of the game and if technical reasons or legal reasons make it impossible to guarantee proper implementation or continuation.
1.7 AMAG reserves the right to take legal action against anyone who has manipulated or attempted to manipulate this competition.
1.8 Participation in the prize draw is possible until 15.10.2023. The draw or prize determination will take place on 17.10.2023. Late entries will not be considered under any circumstances.
1.9 The following prizes are offered:
1st place: 1x Logitec racing steering wheel worth CHF 400
2nd place: 1x headset worth CHF 170
3rd place: 1x Digitec voucher worth CHF 50
1.10 The winner for the prize according to 1.9. will be determined at random among witnesses.
The winner will be notified by AMAG immediately after the end of the prize draw. If the winner does not respond within seven (7) days of notification, the prize will be forfeited and a new winner will be determined.
1.11 Any liability for damages on the part of AMAG and its corporate bodies, employees and vicarious agents arising from or in connection with the prize draw, irrespective of the legal grounds, is limited, to the extent permitted by law, to cases of intent or gross negligence. All operating, ancillary and consequential costs associated with the prize shall be borne by the winner.
1.12 The participant agrees that his/her data may be stored by AMAG and passed on to partner companies within the scope of prize processing. Furthermore, the participant agrees that the pictures and videos he or she sends to AMAG may be used and published by AMAG as part of this competition.
1.13 The legal process is excluded. No correspondence will be entered into regarding the competition.
1.14 The competition is subject to Swiss law.
1.15 These conditions of participation may be amended by AMAG at any time. Should individual provisions within these conditions of participation be or become invalid, this shall not affect the validity of the remaining provisions.
Jeu-concours
L'organisateur de ce jeu-concours est AMAG Import AG, Alte Steinhauserstrasse 12, 6330 Cham (ZG), Suisse (ci-après dénommé "AMAG"). Le jeu-concours est organisé sur la base des conditions de participation suivantes, qui sont acceptées lors de la participation. AMAG est responsable de l'organisation, du déroulement, de la mise à disposition des prix et de la distribution des gains.
1.1 Ce jeu-concours n'a aucun lien avec Facebook, Instagram ou Twitter et n'est en aucun cas sponsorisé, soutenu ou organisé par ces derniers. Toutes les questions, commentaires ou réclamations concernant le jeu-concours doivent être adressés exclusivement à AMAG et non à Facebook, Instagram ou Twitter. En participant à ce jeu-concours, le participant accepte de libérer Facebook, Instagram ou Twitter de toute revendication de tiers en rapport avec ce jeu-concours.
1.2 Sont autorisées à participer les personnes physiques de plus de 16 ans résidant en Suisse et au Liechtenstein. Les personnes de moins de 16 ans, les collaborateurs/collaboratrices, y compris leurs proches, d'AMAG et des sociétés liées à AMAG ainsi que toute autre personne ayant participé à la conception et à la réalisation de ce jeu-concours sont exclus de la participation.
1.3 Les participations multiples à ce jeu-concours sont exclues.
1.4 Les prix ne peuvent pas être transférés, cédés ou échangés. Un paiement en espèces n'est pas possible. La participation au jeu-concours n'entraîne aucune obligation d'achat.
1.5 AMAG se réserve le droit d'exclure à tout moment du jeu-concours, sans préavis ni justification, les participants qui manipulent ou tentent de manipuler le processus de participation ou le jeu-concours et/ou qui enfreignent les règles du jeu. Il en va de même pour les participants qui donnent de fausses informations sur leur personne.
1.6 AMAG est en droit d'interrompre ou de mettre fin au jeu à tout moment, sans préavis, notification ou justification, en tenant compte des intérêts des participants, en cas de suspicion de manipulation du jeu ou si des raisons techniques ou juridiques ne permettent pas de garantir le bon déroulement ou la poursuite du jeu.
1.7 AMAG se réserve le droit d'engager des poursuites judiciaires contre toute personne ayant manipulé ou tenté de manipuler ce jeu-concours.
1.8 La participation au jeu-concours est possible jusqu'au 15.10.2023. Le tirage au sort ou la détermination du gagnant aura lieu le 17.10.2023. Les participations tardives ne seront en aucun cas prises en compte.
1.9 Les prix suivants sont mis en jeu :
1ère place : 1x volant de course Logitec d'une valeur de CHF 400
2e place : 1x casque d'une valeur de CHF 170
3e place : 1x bon d'achat Digitec d'une valeur de CHF 50
1.10 Le gagnant du prix mentionné au point 1.9. sera désigné au hasard parmi des témoins.
Le gagnant sera informé par AMAG immédiatement après la fin du jeu-concours. Si le gagnant ne se manifeste pas dans les sept (7) jours suivant la notification, le gain est perdu et un nouveau gagnant est désigné.
1.11 Toute obligation de dédommagement d'AMAG et de ses organes, employés et auxiliaires d'exécution découlant du jeu-concours ou en rapport avec celui-ci, quel qu'en soit le motif juridique, est limitée, dans la mesure où la loi le permet, aux cas de préméditation ou de négligence grave. Tous les frais d'exploitation, les frais annexes et les frais consécutifs liés au gain sont à la charge du gagnant.
1.12 Le participant accepte que ses données soient enregistrées par AMAG et transmises à des entreprises partenaires dans le cadre du déroulement du gain. En outre, le participant accepte que les photos et vidéos qu'il a transmises à AMAG soient utilisées et publiées par AMAG dans le cadre de ce jeu-concours.
1.13 La voie juridique est exclue. Aucune correspondance ne sera échangée au sujet du jeu-concours.
1.14 Le jeu-concours est soumis au droit suisse.
1.15 Les présentes conditions de participation peuvent être modifiées à tout moment par AMAG. Si certaines dispositions des présentes conditions de participation sont ou deviennent caduques, la validité des autres dispositions n'en est pas affectée.
